General Terms And Conditions On The Use Of GTRANS Transportation Service

DEFINITION AND INTERPRETATION

 

Airport

means the airport(s) in Malaysia whereby GTRANS Airport Transfers is available.

Customer

means any person at whose requests for or on behalf; GTRANS agrees to provide the GTRANS Airport Transfers / normal transportation Services.

Fares

means the taxi meter fare + applicable surcharge, which is exclusive of tolls or any other additional costs, allowable under the regulation or otherwise a fixed fare agreed between Customer and GTRANS.

Pickup Point

means the building or address given by Customer as pickup address.

GTRANS Services

means GTRANS Airport Transfer, normal transportation services or, other travelling and transportation services

GTRANS

Go Trans Management Sdn Bhd and its sub-contractors

Terms and Conditions

means these terms and conditions, as varied from time to time at the sole discretion of GTRANS.

Vehicle

means a motor vehicle the for the purposes of providing the GTRANS Services including Taxi Van, Executive and Luxury vehicle

Website

means the website owned by GTRANS, with the domain name www.gtrans.com.my. These Terms and Conditions apply to all bookings made and services offered through the Website, taxi stand / counter, telephone, fax, email and any other communication mechanism

 

NO SHOW, CANCELLATION AND REFUND POLICY 
Where a Customer has booked for a GTRANS Services, and that the Customer must be ready to depart the Pickup Point no later than 15 minutes from the pickup time. 

 

No Show
Customer’s failure to be at the Pickup Point or to be ready to depart 15 minutes after the scheduled pickup time may result in cancellation of the GTRANS Services. Customer will not be entitled to a refund of any amount of the Fare, if collected and paid. GTRANS be liable for any claims for costs or damages, incurred due to the said ‘No Show’ cancellation. 

 

GTRANS will monitor on your flight status on best effort basis, you are advised to inform GTRANS at 1300-800-CAB (222) or email at customerservices@gtrans.com.my as early as possible for your flight delay/flight cancelled/flight changed to avoid driver make an empty trip. GTRANS will not be responsible for flight delays leading to the forfeiture of your ride and customer will not be entitled to a refund of any amount of the Fare, if collected and paid

 

Cancellation
Customer may cancel GTRANS Services, except for GTRANS Airport Transfer, any time before the scheduled pickup time by calling 1300-800-CAB (222) (if calling within Malaysia) or email at customerservices@gtrans.com.my. Customer is not entitled to any refund, if the arranged transportation has been paid for. 

 

Refund Policy
Customer may cancel GTRANS Airport Transfer 4 hours before the scheduled pick up time by calling 1300- 800-CAB (222) (if calling within Malaysia) or email at customerservices@gtrans.com.my. Customer is not entitled to any refund, if the arranged transportation has been paid for. 

 

LUGGAGE / UNACCEPTABLE ITEMS / DANGEROUS AND PROHIBITED GOODS 

Customers are to agree and ensure that their luggage(s) do not carry not prohibited items, as per Malaysian Law, regulation, respective airline policy and etc. 

It is advisable that the following items be included in Customer luggage that is placed in the Vehicle boot or trailer. GTRANS accept no liability for damage or loss of the following items:
 

  • Cash, negotiable bonds, deeds or other valuable documents and items

 

For safety reasons, articles such as the following must not be carried in customer luggage:

  • Corrosive materials (such as alkalis, acids, wet cell batteries, mercury)

  • Explosives (including fireworks and articles that are easily ignited)

  • Flammable liquids and solids (such as matches, lighters and heater fuels, flammable aerosols)

  • Poisonous, toxic, infectious substances

  • Radioactive materials

  • Compressed Gases (Deeply Refrigerated, Flammable, Non-flammable and Poisonous)

 

ANIMAL 
Guide dogs and other assistance dogs are allowed in GTRANS Services Vehicles but presence of such dogs travelling together MUST be informed at the time of booking. Failing to do so, GTRANS reserves to rights to cancel the booking. No other animals are allowed to be carried in the Vehicles, including non-guide or non-assistance dogs. 

 

WAITING POLICY: 
Generally, waiting time is up to 15 minutes after the scheduled pickup time for Klang Valley to KLIA/KLIA2 and 30 minutes after the scheduled pickup time for KLIA/KLIA2 to Klang Valley. For extension of waiting time, at the earliest possible time, contact GTRANS at 1300-800-CAB (222) or email at customerservices@gtrans.com.my. The request for additional waiting time is subject to the waiting surcharge. 

 

WARM REMINDER: 

Kindly let us have your flight’s arrival/departure time with flight’s number, we will assist you to monitor your pick up time! It is advisable that airport transfer booking, the pick up time should be at least 4 hours before departure time for international flight and 3 hours for local flight. For your information, for pick up from KL city area, the travel time to Kuala Lumpur International Airport (KLIA/KLIA2) is approximately one (1) hour. For pick up from the Kuala Lumpur International Airport (KLIA/KLIA2), you are advised to add one (1) hour after your Flight’s Estimate Time Arrival in order for you to have a buffer time to pass through the immigration, custom clearance and luggage claim. 

 

PASSENGER MOBILITY 
Customers, who require assistance to lift them into and out off the vehicle, must arrange for these services at their Pickup Point and Drop off points. Due to health and safety reasons, drivers are not permitted to participate in carry in passengers into and out off the Vehicles. 

 

LIABILITY 

GTRANS Services will be performed with reasonable care and professionalism. To the fullest extent permitted by law, we shall not be liable for: 
 

  • Any delay in transporting customers

  • Any loss of profits, revenue, business or reputation, economic loss, consequential loss, indirect loss or any other losses incurred as a result of the failure to be in time for a flight arising from or in connection with any GTRANS Services

  • GTRANS will not be responsible for flight delays leading to the forfeiture of your ride.

For GTRANS liability, other than for GTRANS Airport Transfer, under these terms and conditions, is limited to the amount of the Transportation Fare paid by Customer and this limitation shall apply to liability howsoever arising whether in contract, tort or otherwise. 

Our liability for damages resulting by reason of the personal injury or death of a passenger shall be in accordance The Motor Vehicles (Third Party Risk) as required by Part IV of the Road Transport Act 1987 (Malaysia). 

These Terms and Conditions including any exclusion or limitation of liability shall apply to and be for the benefit of GTRANS, its contractors and sub-contractors, agents, employees, directors, representatives and affiliates. 

 

CUSTOMER INDEMNITY
The Customer indemnifies GTRANS, its contractor and sub-contractors, agents, employees, directors, representatives and affiliates, from and against any and all liabilities, claims, damages, losses, costs and expenses arising out of or in any way connected with the provisions of the GTRANS Service except to the extent that such liabilities, claims, damages, losses, costs and expenses are directly and solely caused by the wilful misconduct of GTRANS. 
 

CONDITION OF CARRIAGE
Customer acknowledges that GTRANS engage contractors and sub-contractors to perform services on its behalf, and that the services, which you book using the Website, taxi stand / counter, telephone, fax, email and any other communication mechanism, may be provided by the said Contractors. These terms and conditions will continue to apply in full where GTRANS engages a contractor to provide services on its behalf. 

 

GTRANS or any of its Contractors (which includes any franchisee) or agents may refuse carriage if customer have acquired any services in violation of GTRANS's Website Usage Policy and other policy, Conditions of Carriage or Terms and Conditions, or if you are under the influence of drugs or alcohol, or it is necessary for the safety or comfort of other passengers or for the protection of property.

 

If baggage carried in the boot of the transfer vehicle is damaged, lost or destroyed during carriage, customer must notify GTRANS in writing within 7 days from date of travelled GTRANS undertakes to use their best efforts to carry customer and customer baggage within a reasonable timeframe but does not guarantee to do so. GTRANS may without notice substitute an alternative carrier or vehicle where it deems necessary.

 

Smoking and/or the consumption of alcoholic beverages is not permitted on any of the vehicles or that of its sub-contractors or agents.

 

No agent, contractor, servant or representative of GTRANS has authority to alter, modify or waive any provision of these notices and conditions. 

 

CUSTOMER CONTACTIBILITY
Customer must provide us with a telephone contact number so that our operations staff can get in contact with customer if needed in relation to GTRANS Services. For all bookings, customer (or a member of customer) must be contactable at all times. For GTRANS Airport Transfer, in the 2-hour period prior to customer designated pickup time, Customer must be contactable on the same telephone number that was listed during booking. If customer is not contactable on designated phone number, GTRANS will not be liable for any costs, damages or losses that Customer may incur as a result of delay in scheduled travel time. 

 

PERSONAL DATA CONFIDENTIALITY

  1. GTRANS strive to protect the confidentiality of the personal information (‘data’) of customers, employees, contractors, sub-contractors and business counterparts (hereinafter collectively referred to as ‘data subjects’), that has been provided to GTRANS. Ensuring the security of your personal information is our priority. When we use other parties to provide services to our customers on our behalf (‘service providers’), we also require them to protect the confidentiality of your personal information that they may receive.

 

  1. Choice to Supply Personal Data

    1. The collection of data by GTRANS may be mandatory or voluntary / optional in nature in order to establish or continue to enjoy GTRANS’s services and / or any other business relationships with GTRANS.

    2. It is for you to provide data which are mandatory. If you choose not to supply such data, this may result in GTRANS unable to provide services or otherwise deal with you.

    3. We endeavour to keep you informed of the latest marketing and promotional offers that we feel would be useful and beneficial to you. These may include programs you may find valuable in helping you saving costs on transportation; such as event promotion, travel planning and other benefits.

    4. However, you can choose not to receive these marketing and promotional offers. You can do so by informing GTRANS. Your request will be processed and no fee will be charged.

 

  1. Types of Personal Data Collected

    1. Personal data is described by the Personal Data Protection Act 2010 as information relating directly or indirectly to an individual who is identified or can be identified from that information.

    2. Types of personal data collected may vary according to the business relationship that is established. Data collected may include the following:

      1. Data collected on applications or other forms or as provided by you, such as name, identity card number, address, e-mail address, telephone number and such other information as may be relevant to your application;

      2. Data about your bookings with GTRANS, its service providers, business partners or third parties, such as event participation, frequent locations and account activity;

      3. Data obtained from your access to GTRANS’s web server, for example, by the use of cookies, i.e. small text files, sent by GTRANS’s server to your system when you access GTRANS’s server;

      4. Data from publicly available sources.

         

  2. Use of Personal Data

    1. GTRANS collects your data for the provision of transportation services requested by you in order to meet your transportation needs and objectives.

    2. In addition to the above, GTRANS may also make arrangements with business partners to jointly provide services or launch marketing campaigns that may involve the sharing of your personal information.

    3. Your personal data may be use or processed by GTRANS or its affiliates for the following purposes:

      1. To establish the relationship between you and GTRANS and / or companies related to or affiliated to GTRANS, GTRANS’s service providers and business partners;

      2. To process applications for services;

      3. For the provisions of services to you, whether through voice call booking or through electronic means, including processing of bookings, information on booking status, monitoring of your booked trips, processing of receipts and payments;

      4. For data processing purposes;

      5. To monitor and respond to you on booking status,

      6. To respond to inquiries by you;

      7. To understand your needs and offering services to meet those needs;

      8. For the research and development of services for customers’ use;

      9. To allow GTRANS, GTRANS’s related and / or affiliated companies, service providers and business partners to promote their products and services;

      10. To enable a party to evaluate any actual or proposed assignment, participation, sub-participation and / or novation or our rights and / or obligations;

      11. To meet legal and regulatory requirements, which may include disclosure, notification and record retention requirements;

      12. For such other purposes as permitted by applicable law or with your consent; and

      13. For all other purposes incidental and associated with any of the above.

         

  3. Disclosure of Personal Data 

    1. For the purposes above, your personal data may be provided by GTRANS to:

      1. Any person under a duty of confidentiality to GTRANS or to companies related to or affiliated to GTRANS;

      2. Companies related to and affiliated to GTRANS (whether such company operates in Malaysia or elsewhere);

      3. Any relevant agent, contractor or third party service provider who provides administrative, telecommunication, computer, payment, securities clearance, management, audit or other services to GTRANS;

      4. Lawyers, auditors, tax advisors and other professional advisors which is restricted to the nature of the business relationship in which you are involved in with GTRANS;

      5. Any person or corporation to whom GTRANS transfers or proposes to transfer any part of its interests, obligations, business and / or operations;

      6. Any person by whom GTRANS is required by applicable legal, governmental or regulatory requirements to make disclosure; or to any person reasonably requiring the same in order for GTRANS to carry out the activities set out in the above purposes.
         

  4. Right to Access and Correct Personal Data 

    1. You are entitled to ask whether GTRANS holds the data on you and to request access to and the correction of any such data held. You will be required to fill up a form and a reasonable administrative fee may be charged for processing each data access request.

    2. If you wish to make a request to access to, or to correct data held by GTRANS, please forward your request to GTRANS’s customer service at the telephone number currently stated at GTRANS’s website (www.GTrans.com.my) and we will facilitate the fulfilment of your request as soon as possible.
       

 

FORCE MAJEURE
GTRANS shall have no liability to customer if GTRANS are prevented from, or delayed in performing any GTRANS Services as a result of any act, event, omission or accident beyond our reasonable control, including (without limitation) industrial disputes (whether involving the workforce of GTRANS or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or sub-contractors.

The names of actual companies and products mentioned herein may be the trademarks of their respective owners.

 

VARIATION TO TERMS AND CONDITIONS
GTRANS reserves the right to amend these Terms and Conditions at any time, in its sole discretion. Any amendments to these Terms and Conditions will be effective immediately upon posting on the Website. It is customer responsibility to check for amendments before using the GTRANS Services.

 

GOVERNING LAW AND INVALIDITY
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. The Customer agrees to submit to the exclusive jurisdiction of the Malaysia Courts. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions.
